1. About SOS Mind and These Terms
SOS Mind (“SOS Mind,” “we,” “us,” or “our”) provides educational and self-development content and tools through sosmind.com, the SOS Mind mobile application, and related digital products and services (collectively, the “Services”).
These Terms apply to the website and the mobile application. Additional terms from Apple, Google, payment providers, or other third parties may also apply when you use their platforms or services.
2. Eligibility
The Services are intended for adults. You must be at least 18 years old, or the age of legal majority where you live, to create an account or use account-based features unless applicable law permits your use with valid permission from a parent or legal guardian.
SOS Mind is not directed to children under 13. Do not create an account for a child under 13 or submit personal information about a child under 13 through the Services.
3. Educational and Wellness Purposes Only
SOS Mind provides educational, wellness, self-development, attention-training, reflection, mindfulness, and related content. The Services are not medical care, mental-health treatment, psychotherapy, diagnosis, or a substitute for care from a qualified healthcare professional.
Content about the brain, attention, emotions, habits, mindfulness, or mental well-being is provided for general educational purposes. No content should be interpreted as medical advice or as a recommendation to start, stop, or change any treatment, medication, or professional care.
Your use of SOS Mind does not create a physician-patient, therapist-client, or other professional healthcare relationship with SOS Mind or any author, contributor, or person associated with the Services.
4. Safety and Emergency Situations
Use the Services only when it is safe to do so. Do not use guided practices, audio exercises, breathing exercises, visual exercises, or other features when doing so could distract you from driving, operating machinery, navigating traffic, or another activity that requires your full attention.
Some practices involve breathing, walking, visualization, reflection, or attention to bodily sensations. Stop an exercise if you become dizzy, lightheaded, distressed, disoriented, physically uncomfortable, or otherwise feel that continuing would be unsafe.
SOS Mind is not an emergency or crisis service. If you believe you or another person may be in immediate danger, contact local emergency services or an appropriate qualified professional.
5. Accounts and Account Security
Some features may require an account. You agree to provide accurate information, maintain the confidentiality of your password and credentials, and promptly notify us if you believe your account has been accessed without authorization.
You are responsible for activity conducted through your account to the extent permitted by law. You may not impersonate another person, create an account using information you are not authorized to use, or attempt to gain unauthorized access to another account.
Account deletion is available through the app and may also be requested as described at sosmind.com/delete-account/.
6. Privacy
Our collection, use, storage, and disclosure of personal information are described in the SOS Mind Privacy Policy. The Privacy Policy is incorporated into these Terms by reference to the extent permitted by law.
Journal entries, reflections, feedback, and other free-text fields may contain sensitive or personal information. Include only information you are comfortable submitting to the Services.
7. Free Services and Future Paid Features
SOS Mind may offer some or all Services without charge. We may later introduce optional paid features, subscriptions, purchases, or other offerings. We will provide applicable price and purchase terms before charging you.
Purchases made through the Apple App Store, Google Play, or another platform are also subject to that platform’s payment, subscription, refund, and cancellation rules. Nothing in these Terms changes any non-waivable rights you have under applicable consumer law.
8. Limited Personal License
Subject to these Terms, SOS Mind grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Services for your own lawful, non-commercial purposes.
This license does not transfer ownership of any SOS Mind content, software, methods, trademarks, recordings, exercises, written materials, graphics, or other intellectual property.
9. Intellectual Property
The Services and their content—including text, audio, guided exercises, graphics, logos, designs, software, videos, methods, educational materials, and other original content—are owned by SOS Mind or its licensors and are protected by copyright, trademark, and other intellectual-property laws.
Except as expressly permitted by law or in writing by SOS Mind, you may not copy, reproduce, republish, distribute, sell, license, publicly display, create derivative works from, scrape, systematically extract, reverse engineer, or commercially exploit the Services or their content.
10. Your Journal Entries, Reflections, and Other Content
You retain ownership of original content you submit through the Services, such as Journal entries, reflections, or feedback (“User Content”).
You grant SOS Mind a limited right to host, store, process, transmit, reproduce, and otherwise use User Content only as reasonably necessary to operate, secure, support, and provide the Services, comply with law, and carry out the purposes described in our Privacy Policy.
You are responsible for ensuring that your User Content does not violate another person’s rights or applicable law. Do not submit content that you do not have the right to provide.
11. Acceptable Use
You agree not to use the Services to:
- violate applicable law or another person’s legal rights;
- interfere with, damage, disable, or overload the Services;
- circumvent security, access controls, or technical restrictions;
- introduce malicious code or attempt unauthorized access to systems or accounts;
- use automated means to scrape, harvest, or systematically extract content or data except where permitted by law;
- misrepresent your identity or affiliation with SOS Mind;
- resell or commercially exploit the Services without written permission.
12. Third-Party Services and Links
The Services may rely on or link to third-party platforms, websites, hosting providers, authentication services, email providers, app stores, or other services. Their terms and privacy practices govern your relationship with them.
SOS Mind is not responsible for third-party websites, products, content, availability, or practices, except to the extent responsibility cannot lawfully be excluded.
13. Availability, Updates, and Beta Features
We may add, modify, suspend, test, or discontinue features from time to time. Some features may be labeled beta, preview, experimental, or otherwise under development and may contain errors or change without notice.
We do not guarantee that the Services will always be available, uninterrupted, error-free, or compatible with every device, operating system, network, or third-party service.
14. Suspension and Termination
You may stop using SOS Mind at any time and may delete your account through the available account-deletion process.
We may suspend or terminate access to the Services when reasonably necessary to protect users or systems, address unlawful or abusive activity, enforce these Terms, comply with legal obligations, or discontinue the Services. Where appropriate and reasonably practicable, we will provide notice.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. SOS Mind disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not promise that use of the Services will produce any particular health, emotional, educational, productivity, focus, or wellness outcome.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
16. Limitation of Liability
To the maximum extent permitted by applicable law, SOS Mind and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities arising from or related to the Services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any rights available to you under mandatory consumer-protection law.
17. Responsibility for Misuse
To the extent permitted by law, you are responsible for losses, claims, or liabilities arising from your unlawful misuse of the Services, your material violation of these Terms, or your infringement of another person’s rights. This section does not require you to indemnify SOS Mind for conduct for which applicable law does not permit indemnification.
18. Apple App Store and Google Play
If you obtain the SOS Mind app through the Apple App Store or Google Play, your use of the app is also subject to the applicable app-store terms. Apple and Google are not responsible for providing the SOS Mind Services except to the extent required by their own terms or applicable law.
For iOS, Apple’s standard End User License Agreement may apply to the licensed application unless SOS Mind provides a custom license agreement through App Store Connect. These Terms govern the SOS Mind Services and do not eliminate app-store terms that separately apply to the distribution or licensing of the app.
19. Changes to These Terms
We may update these Terms as the Services, laws, or our practices change. When changes are material, we may provide notice through the Services, by email, or by another reasonable method and may require you to accept updated Terms before continuing to use certain account-based features.
The “Effective date” at the top of this page identifies the current version.
20. Applicable Law and Consumer Rights
These Terms are subject to applicable law. Nothing in these Terms is intended to waive consumer, privacy, or other rights that cannot legally be waived.
Any dispute that cannot be resolved informally will be handled by a court or other forum having jurisdiction under applicable law. Before filing a formal claim, we encourage you to contact us so we can attempt to resolve the matter.
21. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms in a way that would violate applicable law or materially prejudice SOS Mind. We may transfer these Terms in connection with a merger, reorganization, sale of assets, or similar business transaction, subject to applicable law.
